1. No Pattern Day Trading rules: PDT rules require a minimum of $25,000 to be able to day trade. However, trading through LST you only need $5000 minimum capital in your account since you are also trading our firm's funds. And we fully comply with PDT. In addition, your balance can drop below $5000 without penalty – but of course it will affect your leverage. If you only have $4k, your 5/1 leverage is now only $20,000, not $25,000. If your account drops down to $1000 we must take you out of the trade so that you do not lose the firm’s funds. But in a trade, the trade has to go very much against you for you to lose $4000.
2. LST is registered with the Securities and Exchange Commission as a Broker-Dealer: If you trade with a NON-Broker-Dealer proprietary trading firm, without having $25,000 you are definitely in a GRAY area of legality. Regulators are talking about putting more pressure on these types of arrangements, requiring the independent traders to have $25,000 if they are considered Pattern Day Traders (in and out of a trade within the same day 3 days in a row). With LST being a Broker-Dealer, the traders will have no issue with this $25,000 PDT Rule (pattern day trading rule). In addition, there is also a rule that they cannot receive more than 4:1 leverage. Being a Broker-Dealer we can avoid this 4: 1 rule and the $25,000 PDT rule because our traders are not considered a "RETAIL ACCOUNT" and they are trading the firm’s money so it avoids both the 4:1 leverage and PDT rules.
